Resumen : The right of property constitutes one of the legal institutions par excellence throughout history. In this case, and given its privileged and preferential creditor status, the Roman Law managed to configure it with an absolute and excluding character, although this statement deserves nuances, to the point of presenting limitations in its exercise and, even, perform the expropriation by cause of public utility and common interest. Precisely, the public utility and the common interest allow to establish a connection with the right of property in our days through the social function that must fulfill, in virtue of which the individual interest of the owner is subordinated to that of the community. Emerges here the relationship between justice and efficiency in decision-making, fertile field for the economic analysis of law, which allows us to establish, not without risk, the appropriate link with the Roman Law, with the clear intention to claim their projection and incidence in our days despite the conceptual and chronological disparity.
Descripción : El derecho de propiedad constituye una de las instituciones jurídicas por excelencia a lo largo de la historia. En este caso y, dada su condición de acreedor privilegiado y preferente, el derecho romano logró configurarlo con un carácter absoluto y excluyente, si bien esta afirmación merezca matizaciones, hasta el punto de presentar limitaciones en su ejercicio e, incluso, practicar la expropiación por causa de utilidad pública e interés común. Precisamente, la utilidad pública y el interés común permiten establecer una conexión con el derecho de propiedad en nuestros días a través de la función social que debe cumplir, en cuya virtud se subordina el interés individual del propietario al de la comunidad. Emerge aquí la relación entre justicia y eficiencia en la toma de decisiones, campo de cultivo abonado para el análisis económico del derecho, lo que nos permite establecer, no sin riesgo, el oportuno entronque con el Derecho romano, con la clara intención de reivindicar su proyección e incidencia en nuestros días a pesar de la disparidad conceptual y cronológica.
