| Abstract: | Recientemente, hemos visto como un partido político español con representación parlamentaria anunció que había interpuesto acciones legales ante los tribunales españoles contra Twitter, por una presumible vulneración de “derechos fundamentales como la libertad de expresión, el derecho a la participación política, la libertad ideológica y el principio de pluralismo e igualdad política, recogidos todos en la Constitución”. Esta noticia pone en evidencia varias cuestiones que no suelen tenerse en cuenta por el usuario medio a la hora de acceder a cualquiera de las redes sociales más utilizadas, como pueden ser, Twitter, Facebook, Instagram o LinkedIn. Ante esta tesitura, se analizará desde una perspectiva internacional privatista la naturaleza del contrato, así como las cláusulas de sumisión incluidas en los mismos |
| Description: | Recently, we have seen how a Spanish political group represented in parliament announced that it had filed legal action in the Spanish courts against Twitter, for an alleged violation of “fundamental rights such as freedom of expression, the right to political participation, ideological freedom and the principle of political pluralism and equality, all of which are enshrined in the Constitution”. This news highlights several issues that are not usually considered by the common user when accessing any of the most popular social networks, such as Twitter, Facebook, Instagram or LinkedIn. Considering this situation, the nature of the contract will be analyzed from an international private law perspective, as well as the submission clauses included in the contract. |
